My life was miserable, I was addicted to meth, and I was facing two felony charges + some misdemeanors. We searched for the right lawyer and me and my dad decided Phil was our guy. He didn’t promise anything he couldn’t do. Phil gave it to me straight, he said you need to go get help or that I would go to prison. So serenity star in Smithville Texas took me in where I spent 7 months becoming close to God and remembering who I was. Phil kept a close eye on my progress and I felt like what really mattered to him was that I changed my life forever. I’ve been clean for a year now, regularly attend meetings, raise two kids with my girlfriend, attend church, and work 40+ hrs a week. Phil was a huge part of me being able to be who I am today. Thank you forever Phil! Jacob

Put My Experience to Work for You

I have never worked for the government as a prosecutor, represented a bank or defended an insurance company in the courtroom. On the contrary, I have been in private practice for more than 20 years protecting the rights of the common citizen. A courtroom veteran, I have spent my entire career fighting for justice for those accused of DWI and drug possession — whether it be a licensed professional, soccer mom, or college student.

How I Can Help You

Through hard work and preparation, I level the playing field in the courtroom for my clients. By getting to know you I am able to convey your personal story to the prosecutor, opposing counsel, or the jury. If I accept your case, my dedication to your cause will ensure you the best possible outcome.

Criminal Defense

A good defense begins with a good offense. If you expect to receive justice in a Texas courtroom your lawyer must be experienced and prepared. My preparation begins upon our first meeting. Who you are is just as important to me as what happened. Prosecutors have broad discretion— They may prosecute your case to the fullest extent of the law or to dismiss your case. Also, because juries tend to do what they think is right—I want them to like you and help you.

Some people believe that they must accept a conviction following a DWI arrest. After all, they were caught driving after socializing over a few drinks, right? Wrong! This is simply not true. Even more, people believe that because they failed the standardized field sobriety tests or if the breath/blood test results show a high alcohol concentration that there is no use fighting their case. This is absolutely false.

Highly skilled in DWI defense, I may be able to show that the officer lacked probable cause to stop and arrest you. In most cases, I have found that the arresting officer failed to administer the standardized field sobriety tests properly. Additionally, the breath test operator may not have followed his training when administering your breath test. Or, if a blood sample was taken, the phlebotomist may have failed to follow proper medical procedures while drawing your blood. Did you know that the blood draw must be conducted in a sanitary place? Many blood draws occur inside the jail. Not exactly what I would consider a sanitary environment. Finally, the State may fail to prove-up “chain of custody” in order rule out contamination or the possibility that your blood sample got mixed up with that of another. Many times crime lab records may indicate irregularities during the testing of your blood sample calling into doubt their validity.
